At Nuvago Travel & Tourism (“Nuvago”, “we”, “our”, or “us”), we strive to provide reliable, safe, and uninterrupted travel services. However, certain extraordinary events may occur that are beyond our reasonable control and may prevent us or our service providers from fulfilling some or all of our contractual obligations. This Force Majeure Policy explains how such events may affect travel arrangements, bookings, cancellations, and the responsibilities of both Nuvago and our customers.

By booking or using our services, you acknowledge and agree that unforeseen circumstances beyond our reasonable control may require changes to your travel arrangements and that this Policy forms part of our Terms & Conditions.

1. Purpose of this Policy

The purpose of this Force Majeure Policy is to establish a fair and transparent framework for managing situations where extraordinary events prevent or significantly hinder the performance of travel services by Nuvago or our independent suppliers.

This policy seeks to minimize disruption while balancing the interests of travelers, suppliers, and our business operations.


2. Definition of Force Majeure

A Force Majeure Event refers to any event, circumstance, or condition beyond the reasonable control of Nuvago Travel & Tourism that could not reasonably have been anticipated, avoided, or overcome despite taking appropriate precautions.

Such events may temporarily or permanently affect our ability to provide booked travel services.


3. Examples of Force Majeure Events

Force Majeure Events may include, but are not limited to:

  • Natural disasters such as earthquakes, floods, hurricanes, volcanic eruptions, wildfires, or severe storms.
  • Pandemics, epidemics, or public health emergencies.
  • Government travel restrictions.
  • War, armed conflict, terrorism, or civil unrest.
  • National emergencies.
  • Strikes affecting transportation or essential services.
  • Airport closures.
  • Air traffic control restrictions.
  • Unexpected border closures.
  • Power failures affecting critical infrastructure.
  • Cybersecurity incidents impacting essential travel systems.

4. Events Not Considered Force Majeure

The following situations are generally not considered Force Majeure Events:

  • Personal scheduling conflicts.
  • Financial difficulties.
  • Failure to obtain travel documents.
  • Expired passports.
  • Missed flights due to personal negligence.
  • Failure to comply with visa requirements.
  • Changes in personal travel preferences.
  • Minor weather conditions that do not significantly disrupt travel operations.

5. Our Responsibilities

When a Force Majeure Event occurs, Nuvago will make commercially reasonable efforts to reduce disruption and assist affected travelers wherever possible.

Depending on the circumstances, we may:

  • Provide updated travel information.
  • Coordinate with airlines, hotels, and local suppliers.
  • Arrange alternative services where reasonably available.
  • Assist customers in rescheduling bookings.
  • Communicate significant developments as soon as reasonably practicable.

The availability of alternatives depends on the circumstances, supplier policies, and operational conditions at the affected destination.


6. Customer Responsibilities

Customers are expected to take reasonable steps to reduce the impact of Force Majeure Events on their travel plans.

Customers should:

  • Monitor official travel advisories.
  • Maintain valid travel insurance.
  • Keep emergency contact information up to date.
  • Respond promptly to communications from Nuvago.
  • Comply with instructions issued by airlines, hotels, local authorities, and emergency services.
  • Provide any information reasonably required to facilitate revised travel arrangements.

7. Changes to Travel Arrangements

If a Force Majeure Event affects booked travel services, Nuvago may need to modify itineraries, travel dates, accommodations, transportation arrangements, excursion schedules, or other travel services in order to protect customer safety or comply with legal or operational requirements.

Where reasonably possible, we will notify customers of significant changes and discuss available alternatives. Any revised arrangements remain subject to availability and the policies of independent suppliers.


8. Cancellations and Refunds

Where a Force Majeure Event prevents the delivery of booked travel services, cancellations, refunds, credits, or alternative arrangements will be handled in accordance with our Cancellation & Refund Policy, the contractual terms of our independent suppliers, and applicable laws.

As many travel services are provided by independent third parties such as airlines, hotels, cruise operators, transportation providers, and tour operators, refund eligibility may depend upon the policies of those suppliers. In certain circumstances, refunds may not be available even when travel is disrupted by a Force Majeure Event.

Where reasonably possible, Nuvago will assist customers in requesting available refunds, credits, rescheduling options, or travel vouchers offered by the relevant supplier.


9. Travel Insurance

Nuvago strongly recommends that all travelers obtain comprehensive travel insurance before departure. Appropriate travel insurance may provide financial protection against losses arising from unexpected events, including certain Force Majeure situations.

Depending on the insurance policy purchased, coverage may include:

  • Trip cancellation.
  • Trip interruption.
  • Medical emergencies.
  • Emergency evacuation.
  • Travel delays.
  • Lost or delayed baggage.
  • Accommodation expenses.
  • Other insured travel-related risks.

Customers should carefully review their insurance policy to understand its exclusions, limitations, and coverage conditions before traveling.


10. Communication During Force Majeure Events

During a Force Majeure Event, Nuvago will make reasonable efforts to keep affected customers informed regarding significant developments that may impact their travel arrangements.

Updates may be provided through:

  • Email communications.
  • Telephone calls.
  • WhatsApp messages.
  • Official website announcements.
  • Other appropriate communication channels.

Customers are responsible for ensuring that their contact details remain accurate and up to date so that important notifications can be delivered promptly.


11. Limitation of Liability

Except where prohibited by applicable law, Nuvago Travel & Tourism shall not be liable for delays, cancellations, losses, damages, additional expenses, inconvenience, or failure to perform contractual obligations where such circumstances arise directly or indirectly from a Force Majeure Event.

Our liability remains subject to the limitations set out in our Terms & Conditions and any applicable legal requirements.


12. Cooperation with Suppliers and Authorities

During Force Majeure Events, Nuvago may work closely with airlines, hotels, transportation providers, local partners, insurance companies, embassies, government authorities, emergency services, and other relevant organizations to minimize disruption and support affected travelers wherever reasonably possible.

Any alternative arrangements remain subject to availability, operational feasibility, and the policies of the respective service providers.


13. Changes to this Policy

Nuvago Travel & Tourism reserves the right to revise or update this Force Majeure Policy at any time to reflect changes in applicable laws, industry practices, supplier requirements, operational procedures, or business needs.

The most recent version of this Policy will always be published on our official website and shall become effective immediately upon publication unless otherwise stated.
